Terms of Service

The Product is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The Product is licensed, not sold.

INSTALLATION RIGHTS : You may install and use one copy of the software on your server.

SCOPE OF LICENSE : The software is licensed, not sold. This agreement only gives you some rights to use the software. Fast Software Technology reserves all other rights. Unless applicable law gives you more rights despite this limitation, you may use the software only as expressly permitted in this agreement. In doing so, you must comply with any technical limitations in the software that only allow you to use it in certain ways. You may not
- work around any technical limitations in the software;
- reverse engineer, decompile or disassemble the software, except and only to the extent that applicable law expressly permits, despite this limitation;
- make more copies of the software than specified in this agreement or allowed by applicable law, despite this limitation;
- publish the software for others to copy;
- rent, lease or lend the software;
- transfer the software or this agreement to any third party;
- use the software for commercial software hosting services.

COPYRIGHT : The Product is protected by copyright and other intellectual property laws and treaties. Fast Software Technology owns the title, copyright, and other intellectual property rights in the Product. Fast Software Technology name will not be removed from software. Fast Software Technology name will be displayed at Login Screen, at each screen on bottom right footer, on each report at right bottom footer in font size of 9. Client shall not ask for the removal of the name from the software. This will be considered as the breach of the EULA (End User License Agreement ).

CUSTOMER DATA :Fast Software Technology agrees that the data and information updated in the software shall be and remain client's sole property. Fast Software Technology will not use this data, maintain this data. Fast Software Technology representative may access data for support purpose with written permission by authorized representative of customer. Fast Software Technology assures that integrity of customer data will be maintained, and no part of data will be shared with any third parties. Fast Software Technology provides full assurance of non-disclosure of information /data shared during implementation. Also, Fast Software Technology supports protection of privacy of end users of software. However, Fast Software Technology recommends customer to have data backup policy for business continuity purpose in case of failure to access data. Fast Software Technology do not take backup of database after handover of the software licences. Periodic database backup shall be responsibility of client.

APPLICABLE LAW : You agree that you shall use the Software solely in a manner that complies with all applicable laws in the jurisdictions in which You use the Software and Documentation, including, but not limited to, applicable restrictions concerning copyright and other intellectual property rights.

THIRD PARTY PROGRAMS/HARDWARE : All hardware equipment required to execute the project has to be arranged by client. Computers, internal networking, scanners, printers in working condition will be required to be arranged by client. Fast Software Technology is not responsible for the hardware. Fast Software Technology shall not be liable for any failures on account of operating system software issues, network failures, barcode printer/scanner failure, internet access failure, updates in browser while operating on Fast Software Technology software.

LIMITATION OF LIABILITY : TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL FAST SOFTWARE TECHNOLOGY, ITS DIRECTORS, OFFICERS, BE LIABLE TO YOU (WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE) (I) FOR MORE THAN THE AMOUNT OF LICENSE FEES THAT YOU HAVE PAID TO FAST SOFTWARE TECHNOLOGY IN THE PRECEDING (12) TWELVE MONTHS FOR THE APPLICABLE SOFTWARE OR (II) FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE,OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION LOST PROFITS, LOST BUSINESS OPPORTUNITIES, LOSS OF USE OF THE SERVICE OFFERING, LOSS OF GOODWILL, BUSINESS INTERRUPTION, LOSS OF DATA, LOST SAVINGS, OR OTHER ECONOMIC DAMAGE, ARISING OUT OF THIS AGREEMENT OR THE USE OR INABILITY TO USE THE SOFTWARE OR DOCUMENTATION, EVEN IF FAST SOFTWARE TECHNOLOGY HAD BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

JURISDICTION :This Agreement shall be governed by the laws of India. You hereby consent to jurisdiction of the courts of Pune, India

MONEY BACK GUARANTEE : Fast Software Technology assures moneyback guarantee for the satisfaction of the customer, for the period of 1 month from the date of installation. If the customer is not satisfied with services offered by Fast Software Technology, customer can exit the contract. In case if customer exits the contract, within 1-month period, Fast Software Technology will refund full amount received as advance. However, if the services provided to customer includes customisation and multiple visits for training then service charges of Rs. 2500 per visit / modification will be charged and deducted from refund amount of advance. Post issue of the User Licenses, the Money back Guarantee clause stands void.

COMPLETE AGREEMENT : This EULA (including any addendum or amendment to this EULA which is included with the Fast Software Technology Product) is the entire agreement between you and Fast Software Technology relating to the Software Product and it supersedes all prior or contemporaneous oral or written communications, proposals and representations with respect to the Software Product or any other subject matter covered by this EULA. To the extent the terms of any Fast Software Technology policies or programs for support services conflict with the terms of this EULA, the terms of this EULA shall control. This Agreement shall not be amended or modified except in a writing signed by authorized representatives of each party.
